What is alternative dispute resolution?
In an ADR scenario an independent third person assists parties to resolve their dispute.
There are three dominant types of ADR processes:
- facilitative;
- advisory;
- determinative.
Facilitative
This process is where a dispute resolution practitioner assists all parties to the dispute by identifying the disputed issues, developing options, considering alternatives and attempting to reach an agreement about some or all of the issues in dispute. Examples of facilitative processes include mediation, conciliation, facilitation and facilitated negotiation.
Advisory
This process is where a dispute resolution practitioner considers facts arising from the dispute and provides advice as to those the facts, codes, practices, laws, and, in some cases, possible or preferred outcomes and how these might be achieved. Examples of advisory processes include: case appraisal, conciliation (where advice is offered or used) and (early) neutralised evaluation.
Determinative
This process is where a dispute resolution practitioner evaluates the details of the dispute (which may include hearing any formal evidence from the parties) and makes a binding determination. Examples of determinative processes include: arbitration, expert determination and private judgement.
